1. About us
Inka Arthouse is a trading name. The company you buy from depends on the currency of your order:
- UK orders (GBP): INKA & CO UK LTD, registered in England and Wales, company number 17299823, registered office 167-169 Great Portland Street, 5th Floor, London W1W 5PF, United Kingdom.
- All other orders: Inka Arthouse Pty Ltd, ACN 653 270 056, ABN 97 653 270 056, 11/21 McIntosh Street, Airport West VIC 3042, Australia, or its related company in your region.
In these terms, "we", "us" and "our" mean the company you buy from. You can contact us at info@inkaarthouse.com.
2. These terms
These terms apply to your use of inkaarthouse.com and to every order you place with us. They should be read with our Returns & Cancellations policy, Shipping Policy, Privacy Policy and Lifetime Print Guarantee.
3. Using our website
You must be 18 or over, or have a parent or guardian's permission, to place an order.
You must not use our website: (a) for any unlawful purpose; (b) to infringe our intellectual property or anyone else's rights; (c) to submit false or misleading information; (d) to upload viruses or malicious code; (e) to collect or track other people's personal information; (f) to spam, phish, scrape, crawl or spider the website or its content, including by automated means; or (g) to interfere with or get around the website's security. We may suspend or block access for anyone who breaches this section.
All content on our website, including artwork images, product photography, text, designs, logos and the arrangement of the site, is owned by or licensed to us and protected by copyright and other intellectual property laws. You may not copy, reproduce, sell, resell or exploit any part of it without our written permission.
Third-party links
Our website may link to third-party websites that we do not control. We are not responsible for their content, products or practices, and your use of them is subject to their own terms.
Reviews, photos and other submissions
If you send us or post reviews, photos, comments, ideas or other content, you give us a free, worldwide, non-exclusive licence to use, edit, publish and display it in connection with our business, including on our website and social media. You confirm the content is yours to share, is accurate, and does not infringe anyone's rights or contain anything unlawful or offensive. We may remove any content at our discretion.
4. Orders
When you place an order, you are offering to buy the products in your cart. A contract is formed when we send you an order confirmation email.
We may decline or cancel an order before dispatch only for a genuine reason, for example if a product is unavailable, there is an obvious pricing error, we suspect fraud, or we cannot deliver to your address. If we do, we will tell you and refund you in full.
We may limit the quantity of any product per customer, household or order, and may decline orders that appear to be placed by dealers, resellers or distributors, or that breach a promotion's terms. If we cancel an order for any of these reasons, we will refund you in full.
5. Prices and payment
Prices are shown in your local currency. Prices include any applicable GST or VAT, except US sales tax, which is calculated at checkout where it applies. Any delivery charge is shown at checkout before you pay.
If we discover an obvious error in the price of a product you have ordered, we will contact you before dispatch and you can choose to buy at the correct price or cancel for a full refund.
6. Delivery
Delivery estimates are set out in our Shipping Policy. If we cannot dispatch your order within the time we have told you, we will let you know, give you a revised date and offer you the option to cancel for a full refund. Your order is your responsibility once it has been delivered to the address you gave us.
7. Returns and cancellations
You can return items within 30 days of delivery as set out in our Returns & Cancellations policy. UK and EU customers also have a legal right to cancel within 14 days, explained in that policy.
8. Products
We make every effort to show our products accurately, but colours can vary slightly between screens and the finished print. Each print is made to order in standard sizes.
9. Our responsibility to you
Nothing in these terms excludes or limits any right you have, or any liability we have, that cannot be excluded or limited by law. This includes the consumer guarantees under the Australian Consumer Law, your rights under the New Zealand Consumer Guarantees Act 1993, your rights under the UK Consumer Rights Act 2015 and EU consumer law, any implied warranties under US law, and our liability for death or personal injury caused by our negligence or for fraud.
Subject to that, we are not responsible for loss or damage that was not reasonably foreseeable when you placed your order. Our products are for domestic and private use, and we are not responsible for any loss of profit, loss of business or business interruption.
10. Your legal rights
Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
United Kingdom: We are under a legal duty to supply products that are in conformity with the contract. Nothing in these terms affects your statutory rights. For information about your legal rights, contact Citizens Advice.
European Union: Nothing in these terms affects the mandatory consumer protections of the country where you live.
United States: We do not disclaim any implied warranties. Some states do not allow limits on incidental or consequential damages, so the limits in section 9 may not apply to you. You may have other rights which vary from state to state.
11. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones shown on our website when you placed it.
12. General
If any part of these terms is found to be invalid or unenforceable, the rest of the terms remain in full effect. If we do not enforce a right straight away, we can still enforce it later. These terms, together with the policies referred to in section 2, are the entire agreement between you and us for your order.
13. Governing law and disputes
UK customers: These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home country.
All other customers: These terms are governed by the law of Victoria, Australia. If you live in the EU, the US or another country or state with mandatory consumer laws, you keep the protection of those laws and may bring proceedings in the courts of your country.
