This Privacy Policy describes how Inka Arthouse collects, uses and discloses your personal information when you visit or make a purchase from inkaarthouse.com (the "Site").

Who we are

The company responsible for your personal information (the "controller") depends on where you shop with us:

Information we collect

Device information: browser version, IP address, time zone, cookie information, the pages and products you view, search terms and how you interact with the Site. Collected automatically using cookies, log files, web beacons, tags and pixels, to load the Site correctly and to understand and improve how it is used.

Order information: name, billing address, shipping address, payment information, email address and phone number. Collected from you, to fulfil your order, process payment, arrange delivery, send order confirmations, communicate with you and screen orders for fraud, and, in line with your preferences, to send you marketing.

Customer support information: your name, email address, order details and the content of your messages. Collected from you, to provide customer support.

You must give us your name, contact details, delivery address and payment information to place an order, as we need them to fulfil our contract with you. If you do not, we cannot process your order. Giving us any other information, and agreeing to marketing, is optional.

Minors

The Site is not intended for individuals under the age of 18. We do not intentionally collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, please contact us to request deletion.

Sharing your information

We share your personal information with service providers who help us run our business and fulfil your orders, including:

  • Shopify, which powers our online store (shopify.com/legal/privacy)
  • Payment providers, to process your payment
  • Delivery carriers, to deliver your order
  • Email and SMS marketing providers, such as Klaviyo, to send messages you have agreed to receive
  • Analytics and advertising partners, such as Google, Meta and TikTok, to understand how the Site is used and to show relevant ads
  • Customer service and IT contractors who support our team

We may also share your information to comply with the law, respond to lawful requests, or protect our rights. We do not sell your personal information for money.

Advertising and analytics

We use Google Analytics to understand how customers use the Site (Google's privacy policy). You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout.

We share information about your use of the Site, your purchases and your interaction with our ads with our advertising partners, sometimes through cookies and similar technologies, which you may consent to depending on where you live. Cookies and similar technologies

Cookies are small files stored on your device when you visit our website. We also use similar technologies such as pixels and tags. We group them as follows.

Essential: run the store, keep items in your cart, keep checkout secure and remember your privacy choices (for example Shopify cart, checkout and session cookies). These do not need consent, as the site cannot work without them.

Analytics: help us understand how visitors use our website so we can improve it (for example Google Analytics and Shopify analytics). We use these only with your consent where the law requires it, including in the UK and EU.

Marketing: measure our advertising and show you relevant ads on other websites and apps (for example Meta pixel, Google Ads, TikTok pixel and Klaviyo). We use these only with your consent where the law requires it, including in the UK and EU.

Most cookies expire between 30 minutes and 2 years after they are set.

Managing your choices: you can change or withdraw your consent at any time using the cookie settings link in our website footer. You can also block or delete cookies in your browser settings, although parts of the website may not work properly.

Do Not Track

There is no consistent industry standard for responding to "Do Not Track" browser signals, so we do not change our practices when we detect one.

Legal bases for using your information (UK and EU)

If you are in the UK or EU, we use your personal information on these legal bases:

  • To fulfil your order and provide customer support: performance of our contract with you
  • To keep tax and accounting records: compliance with our legal obligations
  • To prevent fraud, secure the Site and improve our services: our legitimate interests, which do not override your rights

How long we keep your information

  • Order and transaction records: 7 years, to meet tax and accounting obligations
  • Customer support records: 3 years after your last contact with us
  • Marketing data: until you unsubscribe or withdraw consent

Automated decision-making

We do not make decisions using only automated processing that have a legal or similarly significant effect on you. Our platform provider Shopify uses limited automated fraud prevention, such as temporarily blocking IP addresses or cards linked to repeated failed transactions for a few hours or days.

International transfers

Our team and service providers are located in several countries, so your information may be stored and processed in Australia, New Zealand, the United Kingdom, the Netherlands and other EU countries, the United States, Canada, Ireland and the Philippines. Where UK or EU data is transferred to a country without an adequacy decision, we rely on appropriate safeguards such as standard contractual clauses.

Your rights

Everyone: you can ask to access or correct the personal information we hold about you, and unsubscribe from marketing at any time using the link in our emails or by replying STOP to our SMS.

UK and EU residents: you also have the right to have your information erased, to restrict or object to our use of it, to data portability, and to withdraw consent at any time. You have the right to complain to the Information Commissioner's Office (ico.org.uk) in the UK, or to your local data protection authority in the EU.

Australian residents: if you are not satisfied with how we handle a privacy complaint, you can contact the Office of the Australian Information Commissioner (oaic.gov.au).

New Zealand residents: if you are not satisfied with how we handle a privacy complaint, you can contact the Office of the Privacy Commissioner (privacy.org.nz).

US residents: you can ask to know, access, correct or delete the personal information we hold about you. Depending on your state, you may have additional rights.

Mobile Terms of Service

The Inka Arthouse mobile message service (the "Service") is operated by Inka Arthouse ("Inka Arthouse", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Inka Arthouse's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Inka Arthouse through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Inka Arthouse. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Reply STOP to any message from us or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Inka Arthouse mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
